There will be a 10% buyer’s premium or $5,000 whichever is greater.  The total purchase price will be determined by adding the high bid and the buyer's premium which will then constitutes the total purchase price.  The winning bidder will deposit 10% of the total purchase price with a personal or business check and will sign a letter of instruction that the deposit i NON-REFUNDABLE if the winning bidder defaults on the terms and conditions of the contract.  The winning bidder will close the transaction within 30 days of the live auction event or by February 15th, 2016.

Basic Terms:

This is a 4 bedroom, 3.5 full bath residential property & two car attached garage being sold at Public Auction with a buyer’s premium of 10% or $5,000 (whichever is greater) and sells AS-IS without contingencies (either financial or conditional).

The high bid plus buyer’s premium will constitute the total purchase price.  The winning bidder will then deposit 10% of the total purchase price as a non-refundable down payment to the Ohio Real Estate Auctions, Real Estate Broker.  Down payment will be given back to the buyer when said buyer closes within the terms of this contract.  Every prospective bidder must sign a letter of “irrevocable instruction” which defines that all deposits are non-refundable. Each registered bidder must deposit their down payment with a personal or business check made payable to Ohio Real Estate Auctions., have a State issued photo Identification and register by signing the “Auction Registration Form” and “Terms & Conditions Form”.  Auctioneer may make changes to terms and condition within his fiduciary responsibility to the seller (client), in the best interest of the client.  If changes are made, they must be reduced to writing and signed by both parties, (buyer and seller).  If the high bid is $100,000 the buyer’s premium is $10,000 and the total purchase price is $110,000.  Therefore the non-refundable down payment is $11,000.00.  The winning bidder may ask for an extension and if agreed by the seller will pay a $200 per diem. 

Once a bidder has met the requirements to bid and then becomes the winning bidder (he/she) will sign all necessary contracts and submit a personal/business check for the necessary down payment.  The winning bidder(s) will then have 30 days from the live auction event to successfully close the transaction with FirstAmerican Title Insurance Company.
